Puppy will be taken to your D.V.M. with in 3
business days of receiving puppy, to be examined for a well puppy check up.
Your D.V.M. will fill out the "proof of vet exam" that will be in
your puppy package & you will mail it back to me to be kept on file.
Congenital Defect Warranty: In the event the puppy is diagnosed with a congenital
defect that is life threatening, crippling, requires routine management by
medication, or is fatal, and then upon proof of defect and treatment and/or
euthanasia, by a D.V.M, the breeder will replace the puppy, with the same
gender/quality when one becomes available. No monetary refunds will be given. If
puppy is alive, proof of spay/neuter must be furnished prior to
replacement.
2 Year Eye & Hip Warranty: In the event the puppy is diagnosed with hip dysplasia by
the OFA and/or bilateral luxating patellas NOT DUE TO INJURY, a
cataract by the C.E.R.F. specified as "likely hereditary" on the exam form, then
the breeder will replace the puppy with a puppy of the same gender/quality when
one is available. Proof of spay/neuter must be furnished prior to replacement.
Limits of Liabilities: These conditions will NOT be warranted: allergies, thyroid
dysfunction, cherry eye, hernias, conformation, teeth, coat color or density,
pigmentation, size, weight, dandruff, skin conditions, reproductive organs,
reproductive disorders, or any autoimmune disorders that may be caused by
environmental factors.
It is agreed the temperament is suitable at time
of sale, and no warranties on temperament exist. Breeder will not be responsible
for any expenses. Breeder may at her discretion require a second veterinary
opinion and/or autopsy report. All health warranties are null and void if the
purchaser breaches any portion of the agreement, and health warranties are not
transferable to third parties.
Shelter: Puppy will not be confined to a crate or
cage as a primary means of shelter. Housing conditions must be sanitary, and
spaciousness to provide adequate exercise. Puppy will not be tied or chained
outside. Fresh water will be available at all times. Seller has the right to
inspect puppy and puppy’s environment.
Pertaining to general care: Puppy will need
routine grooming, annual exam, wormings and vaccinations as recommended by a DVM
and puppy is to be fed a premium puppy food first 12 months and a premium dog
food after 12 months in which the main ingredient is NOT corn. Preferably
Natural Choice Lamb and Rice or Nutro Ultra. Health warranty will not be honored
if puppy is fed a diet in which the main ingredient is corn.
Due and reasonable care will be taken to confine
puppy to the property of the purchaser. Puppy will not be allowed to roam at
large. Puppy is NOT to be chained for any reason at any time! If at anytime, the
Breeder finds the conditions that the dog is living in, inhumane, the Breeder
has the right to remove and repossess the ownership of the animal. If out of
state, purchaser is liable for legal and/or shipping expenses incurred to
enforce this term.
Purchaser will not "broker" the puppy, or any of
its offspring. If the purchaser cannot keep or does not want to keep the puppy,
the purchaser will offer in writing, to return the puppy to the breeder. No
funds will be exchanged unless the puppy is re-sold by the breeder, and then any
net profit less expenses (i.e. vet bills, feed, advertising) will be given to
the original purchaser. Purchaser shall be liable to pay monetary compensation
to the breeder if puppy is given away, sold, or otherwise transferred or
disposed of without offer of first refusal, in the amount of $250.00 if puppy
has been spayed/neutered or $1000.00 if puppy was not spayed/neutered at time of
transfer/disposal. Puppy will be assumed as un-sterilized if no proof furnished
to the breeder. Purchaser is liable for legal expenses incurred to enforce this
term. Health warranties are not transferable to third parties.
Purchaser will not breed puppy on first heat cycle
or before one year of age. Purchaser agrees to breed puppy only to a dog with a
champion pedigree. Puppy is not to be bred past the age of 6 years
old.
Signatures indicate agreement on this the _____day
of _________, 20____. This agreement will be considered in effect at time of
physical transfer/air shipped, and is legally binding.
